Terms and Conditions.

Please carefully read these rules and conditions of membership and our privacy policy before you complete and hand the membership application to reception as they are legal and, for insurance purposes, binding.

Virtually all rules are straightforward common sense and there for everyone’s benefit and protection. If you need any guidance on their implications or on membership details, please don’t hesitate to contact us.

  1. A person wishing to become a member of Elite Fitness must complete the official application form which should be submitted to Elite Fitness either in signed paper form or using the online sign up where applicable. The minimum age of a member is 16 years old.

  2. All members must respect the facilities, staff and fellow members at all times, which includes but is not limited to:

    • Parking considerately in the car park and not parking illegally in the surrounding areas while using gym.

    • Wearing appropriate clothing in the gym. No jeans or dirty work clothes/footwear. Tops and appropriate footwear must be worn at all times outside of the changing area.

    • Children under 16 should not be left unsupervised at any time anywhere in the gym, including the social area and therapy/barber rooms by reception. If found to be unsupervised, the child and parent will be asked to leave immediately and the child will be unable to return in any capacity until they are 16.

    • Filming/Photography is currently permitted within the gym however no other gym members should be captured in film or still image. It is the responsibility of the person filming to obtain agreement of anyone around them BEFORE filming/taking photos and can not photograph/film without total consent of everyone that may be impacted. Retrospective consent should also be obtained where images are accidentally captured, and the image/footage deleted where consent is withheld. If you intend to use an image, then you must explain what it will be used for and who might see it and get the persons consent to do so.  Anyone caught taking images without permission will be banned from the gym. The use of tripods or other equipment not directly related to your workout is prohibited so that other gym users can maintain full use of the rest of the gym. Elite Fitness staff reserve the right to see any and all images taken within the gym building. Failure to show Elite Fitness staff any images will result in the member being banned from the gym. If in doubt, do not take any images.

    • Do not leave your personal items (eg. bags, hoodies, etc) on machines or benches and allow other members to ‘work in’ and use equipment during your rest periods. Large bags should not be brought onto the gym floor and should be left in the lockers.

    • You should be in control of the weights at all times. Please do not slam or drop weights as it may damage them or hurt you or the people around you.

    • Put your equipment back in the correct place after use. Wipe down benches and equipment with antibacterial sprays and blue rolls situated around the gym floor and ensure any rubbish is disposed of in the relevant bins.

    • If you are unsure how to use any equipment please ask a member of staff or PT, we want you to stay safe and get the best out of your workout.

    • If you notice any piece of equipment is damaged, whether you have accidentally damaged it or found it in that condition, please let us know at reception. We appreciate accidents happen and want to ensure equipment is repaired without any unnecessary delay and no other user could come to harm by using any damaged equipment.

    • Members are only allowed access to the communal areas and should not enter any doors marked ‘Private’ or ‘Staff’ or come behind the reception desk at any time.

  3. Elite Fitness reserves the right to reject any application for membership without giving any reason for doing so, in which case full membership fee will be refunded immediately.

  4. A successful membership applicant will need to have a single digit fingerprint taken to validate their entry before they can start using the gym. This can be done at reception during staffed hours. Where the system is unable to take a successful fingerprint the member may be issued a physical access device (card or key fob) which will remain the property of Elite Fitness. All members will be required to scan their relevant finger or access device on each and every entry to the members section. If you have been issued with an entry fob and you have lost it you must inform Elite Fitness immediately and you can then purchase a replacement for £10. If your fob becomes damaged you can return it to reception and we will replace it free of charge. You must return your fob to Elite Fitness when your membership expires. If you do not return your fob and you rejoin in future and require a new fob you will be charged £10 in addition to your chosen membership cost.

    If a new or renewing member refuses to provide a fingerprint for entry we can allow them to purchase a fob for £10, but we will need to take a photo of that member to ensure only they use it to gain entry.

  5. Smoking/Vaping is not permitted anywhere in the building or car park.

  6. Memberships are not transferable.

  7. Elite Fitness shall determine the membership charges for the use of the facilities. These may vary at the discretion of Elite Fitness. A list of charges in force will be available at reception. Concession rates will be provided if the applicant wishes to limit their membership to off-peak hours (any time except between 5:30am - 8:30am and 4:00pm - 9:00pm Monday to Friday), or if a valid photographic identification is provided confirming they are in full time education or for anyone over the age of 65, where valid proof of age is provided (driving license, passport, etc). Fixed term memberships run from the date the membership is taken out for one calendar term, for example a 1 week membership taken out on a Monday will expire at midnight on the following Sunday, a 1 month membership taken out on 15th of the month will expire at midnight on the 14th of the following month.

  8. Membership can be renewed by payment to Elite Fitness on or before the expiry date shown on the Elite Fitness database, which will be one membership term (as selected by the member) from the date of sign up. Elite Fitness reserves the right to refuse renewal of membership without reason for the decision.

  9. Cancellation: Elite Fitness will not refund any part of the membership fee for non-usage of clubs facilities. Fully paid members will not receive any refund if they choose to cancel their membership early.

    Annual Members paying monthly may only cancel their membership once their 3 month initial contract period has ended.  One full months calendar notice in writing is required (email to info@elitefitness.im or by social media message); by definition one calendar months notice is a full month following the last payment due date of any standing order based on the start date of the membership.

    Where payment is made by Direct Debit via Ashbourne, Elite Fitness will arrange for the cancellation of this payment after the next direct debit payment due date, which will be the final payment and cover the notice period. If Direct Debits are cancelled by the member directly with their bank their membership will be terminated immediately regardless of when they last paid. Where payments are made by standing order (if the member has completed the standing order payment details on the paper version of the membership form addressed their bank rather than the digital/online Direct Debit form), it is the responsibility of the member to cancel this instruction directly with their bank (or via their online banking). Elite Fitness will refund any paid membership fees where the member has not taken the appropriate action with their bank if notified within 30 days.

    When a member cancels their payments prior to the required notice period or does not give notice at all, Elite Fitness may choose to only accept fixed term memberships from them for any future use of the gym. The member will then be unable to select an annual membership paid monthly by Direct Debit or Standing Order.

  10. Payment of any membership fees due are the sole responsibility of the member and although Elite Fitness may provide notification of missed payments, this should not be relied upon. We advise checking your bank transactions on a monthly basis to ensure payments have been made. Where payments for Direct Debits via Ashbourne are missed, Ashbourne may apply additional fees which are outside the control of Elite Fitness. Please make yourself aware of all the Terms and Conditions sent to you by Ashbourne when you sign up. Where payments are made by standing order, a missed payment for whatever reason will result in the immediate termination of the member’s gym access. Any future payments made will not be refunded and the member’s gym access will only be reinstated once the outstanding missed payments have been made in full. If a member cancels their payments without the contractual written notice they will be unable to use the Elite Fitness facilities again at any point in the future until the outstanding amount owed (the greater of either the minimum 3 month term or 1 calendar month’s notice period) is paid in full.

  11. Only annual memberships paid by direct debit or paid in full can be frozen at the discretion of Elite Fitness management and only if you are medically unable to attend (a doctors note will be required confirming the total number of months in full you are medically advised not to partake in any physical exercise, part months will not be taken into account), or if you are leaving the island (proof of travel dates will be required), for 3 consecutive months or longer as a one off trip during the full term of your membership (membership can not then be frozen again at any point). The membership may then be frozen for an agreed number of months before it will automatically recommence. Open ended membership freezes will not be permitted. Fixed term memberships less than 12 months and annual memberships paid by standing order are not able to be suspended.

  12. Membership may be withdrawn at any time without notice at the sole discretion of Elite Fitness. In the event of such withdrawal, or in the event of the member wishing to withdraw, a refund of the fee shall be at the single judgement of Elite Fitness.

  13. Elite Fitness may contact the member using any of the contact details provided on the membership form (or Free Day Pass form) regarding membership but these details will not be passed on to any third party.

  14. Elite Fitness shall be entitled without prior notice to vary opening/closing times, including 24/7 access. The club shall be entitled to make alterations, carry out repairs or maintenance without prior notice, though of course, every consideration will be made to minimise inconvenience. There shall be no refund of the membership fee for any variation in the facilities/machines/equipment availability.

  15. Elite Fitness employs staff to manage the gym but supervision of each area is not possible at all times, therefore, Elite Fitness does not accept liability for any person’s accident, injury or misadventure. Elite Fitness requires all users to ensure their health and physical condition is such as not to involve any risk to him/herself or any other person using the club and reserves the right to require the withdrawal, from any facility, of any person who may be considered or constitutes a risk.

  16. Any personal property is brought into the gym at the member’s own risk and Elite Fitness will not be responsible for any loss or damage, however caused, including the car park.

  17. The facilities must be vacated when requested by staff or on sounding of the fire alarm and wait by the 4 bay car park next to the entrance from the main road.

  18. Anyone found on the premises under the influence of alcohol or any other drug will be banned for life.

  19. Members must not let anyone in or out of the secure areas within the gym, especially as they enter or leave the premises. You must notify us of the date and time if someone attempts to follow you in without successfully scanning in their fingerprint/fob.

  20. 24/7 Access:

    Access to the gym outside of our published opening times is solely at the discretion of Elite Fitness as is not included as part of the membership. Elite Fitness reserve the right to suspend access for maintenance or safety reasons, although we will endeavour to keep this to a minimum. If the entry system does not allow you access, please check your membership and validation at reception during staffed hours.

    Each member should scan in to validate their membership and only then if the door unlocks should they enter the gym and ensure the door is completely closed behind them. Members must not allow anyone else to enter the gym with them.

    There is an infrared barrier on the external door which records the date, time and number of times the barrier is broken and in which direction, either via entry or exit. Where the number or direction of movement does not coincide with either a member scanning in or a push button exit, management will be automatically notified with a CCTV record.

    If ANY rules are broken at any time (during both staffed and unstaffed hours) members may have their 24/7 access revoked and will only be able to access the gym during our staffed hours.

    Although any rule breaking will not be accepted, Elite Fitness will be actively monitoring for:

    • If a member is found to be letting anyone else in that has not had a successful entry validation

    • if a member does not put back any equipment in the correct place (including weight plates) that they use.

    You must not obscure your face when entering a secure door, for example do not wear a helmet, cap or have your hood up. If your entry validation is used to enter a secure door and you are not identifiable we reserve the right to immediately disable your access on all doors.

    You must have a fully charged mobile phone with you at all times when in the gym outside of our staffed opening hours.

    Access is only permitted to the changing room, cardio room and upstairs gym during unstaffed hours.

    For insurance and safety reasons the saunas must not be used during unstaffed hours.

    Use of the lockers during unstaffed hours are at the member’s own risk and if the PIN is not reset properly may result in that locker remaining locked until the gym is next staffed. Lockers may only be used while you are in the gym and Elite Fitness reserves the right to empty any lockers should it be deemed that a member is continually using a locker outside of these times. Any recovered items will remain at reception for 5 days before being disposed of.

  21. Upon completing the membership form and joining or renewing an expired membership, the member will accept and be bound by the above conditions relating to their membership, which may change from time to time. The purpose of the terms, conditions and rules are to ensure, at all times, the well-being and enjoyment of all users.

PARQ

You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice. 

You should make yourself aware of any rules and instructions, including warning notices. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.

You should let us know immediately if you feel ill when using our equipment or facilities. Our staff members are not qualified doctors, but there will be a person available who has had first-aid training.

You must follow any reasonable instructions to allow you to exercise safely.

Regular exercise is associated with many health benefits, yet any change of activity may increase the risk of injury. Consideration of these questions is the first step when planning to increase the amount of physical activity in your life.

Please read each question carefully and answer them honestly:

  1. Has a physician ever said you have a heart condition and you should only do physical activity recommended by a physician?

  2. When you do physical activity, do you feel pain in your chest?

  3. When you were not doing physical activity, have you had chest pain in the past month?

  4. Do you ever feel a loss of consciousness or do you lose your balance because of dizziness?

  5. Do you have a joint or bone problem that may be made worse by a change in your physical activity?

  6. Is a physician currently prescribing medications for your blood pressure or heart condition?

  7. Are you pregnant?

  8. Do you have insulin dependent diabetes?

  9. Are you 69 years of age or older?

  10. Do you know of any other reason you should not exercise or increase your physical activity?

If you have answered “YES” or if your health changes so you then answer “YES” to any of the above questions, please check with your doctor BEFORE you become more physically active. Any person who undertakes exercise against the medical advice of their doctor shall do so at their own risk and Elite Fitness shall not be held responsible in the event of any illness or fatality which may result.
